World Customs Organization (WCO), the main international organization dealing with Customs matters. According to the Sino-British agreement it will also retain separate standing in the GATT, the General Agreement on Tariffs and Trade.

General Agreement on Tariff and Trade (GATT), under the Agreement on Textiles and Clothing of the GATT, which replaced the Multi-Fiber Arrangement, a number of bilateral agreements regulating the export of Hong Kong textile products have been negotiated with Austria, Canada, the United States and the European Union nations. General Import Clearance Information

Clearance Process

Most of Hong Kong's international traffic arrives at either its airport or at its cargo seaport and entry is submitted to the Customs & Excise Department at those locations. Shipments arriving by land from China must have an import/export declaration filed at the border. For more information, contact the Hong Kong Trade and Industry Department. For air shipments, customs clearance is initiated by the carrier sending cargo information to C&ED electronically through the ACCS (Air Cargo Clearance System) prior to the arrival of the aircraft. For shipments arriving by land or sea, manual paperwork is submitted. C&ED staff will review the inbound cargo information and assign constraint codes to shipments which are restricted, prohibited from entry or which are subject to excise duty (Tobacco, Liquors, Methyl Alcohol, Hydrocarbons Oil). Shipments with constraint codes must be presented to C&ED staff and any other relevant government departments upon arrival. Shipments subject to control by other government departments will be held until the controlling department has been contacted for their instructions and that department has granted an endorsement. The controlling department may perform a physical examination. Shipments without a C&ED constraint code and those which have been examined and released by C&ED are considered cleared through customs.

Persons importing counterfeit goods, infringing copyright laws related to computer software, music CD's and tapes, etc. will be held liable for criminal prosecution.

Except for certain exempted articles like sample shipments valued under HKD 1,000, import shipments usually require an import declaration and, depending upon the commodity, may also require an import license from the government agency which regulates that commodity. When required, the import declaration must be submitted by the importer to the Census & Statistics Department within 14 calendar days of shipment arrival and must include the Harmonized Schedule (HS) statistical data. Unlike many countries, it is possible for a shipment to be cleared through customs before HS number classification has been provided to the government. For those commodities which are subject to excise duty (Tobacco, Liquors, Methyl Alcohol, and Hydrocarbons Oil), the importer must pay the excise duty and obtain an import permit before the Hong Kong Customs and Excise Department (C&ED) will release the shipment. It is the responsibility of the importer to follow the procedures necessary to become a licensed importer and to obtain the required import licenses and permits from the appropriate agency(ies). It is important that the names and addresses of the foreign exporter and of the Hong Kong importer are consistent on all shipping and license documents.

Import licenses are specific and are issued by the relevant government departments. Examples of licenses and permits are found on many of the Hong Kong government department web sites such as http://www.info.gov.hk/customs/eng/major/license_e.html, the website for the Hong Kong Customs and Excise Department. Application is made by the importer to the appropriate government department, if possible, prior to the shipments arrival. Carriers, forwarders, and agents may not apply for an import license on behalf of the consignee. The licenses may be valid for up to 6 months and may or may not have quantity restrictions.

Textiles Trader Registration Scheme
Hong Kong has instituted the Textiles Trader Registration Scheme (TTRS) that provides an alternative to the standard textile license requirements for certain textile goods. Those companies which participate in this scheme have been exempted from many import and export licensing requirements and can make application through EDI. Document Requirements
Air Waybill or Bill of Lading
There are no special requirements; however, whenever other documents such as a commercial invoice are included, it is important that the name and address of the foreign importer or exporter and the name and address of the Hong Kong party are consistent on all shipping and license documents.

Commercial Invoice
Commercial invoices are not required to obtain clearance but are needed for advance clearance processing. They are used to identify the different types of licensable shipments and to contact importers prior to arrival in order to obtain any missing information or documentation. It is recommended that all shipments shipped via FedEx have a commercial invoice prepared and included with the shipment when exporting to Hong Kong.

Import Declaration
An import declaration must be lodged with the Census and Statistics Department for all shipments after the receipt of the goods but within 14 calendar days of importation. It is not required for sample shipments valued below HKD 1000, gifts or personal shipments. Declaration charges are assessed at the rate of HKD 0.5 for the first HKD 46,000 of value plus HKD 0.25 for each additional HKD 1,000 or part thereof and rounded up to the nearest 10 cents. The declaration must be submitted through EDI via Tradelink or Global e-Trading to the Census and Statistics Department.

Import License
Import licenses are specific and are issued by the relevant government departments and may be valid for up to 6 months. There may or may not be quantity restrictions. Application is made by the importer directly to the government department. See the "Useful Contact Information" section of this profile regarding information on government departments and specific products they control. Import licenses are required for the following:

Dutiable Commodity Permit
Dutiable commodity permits, also called DCP are electronic permits and required for each importation of dutiable goods. The permits are issued by the Customs & Excise Department (C&ED) to an importer after the payment of excise charges. Once obtained, it must be submitted to C&ED to obtain release of the shipments



Customs Valuation
Customs valuation is applied to duty/tax assessment for import of dutiable commodities, i.e. liquor, tobacco, hydro-carbon oil and methyl alcohol. The value of goods for the purpose of assessing the ad valorem excise duties is determined under the Dutiable Commodity Ordinance.

Import Duties
The Hong Kong Special Administrative Region of the People's Republic of China (HKSAR) is a free port and does not levy any Customs tariffs, tariff quotas or surcharges on imports. Nor does "value added" or "general services" taxes on imports apply. There are import duties that are levied on 4 types of goods irrespective of whether they are imported or locally manufactured. Technical barriers or non-tariff barriers to trade as they are sometimes known, can cause many problems for exporters looking for new markets for their products. These barriers can be in the form of regulations, standards, testing and certification procedures. The World Trade Organization (WTO) Agreement on Technical Barriers to Trade tries to ensure that these barriers do not create unnecessary obstacles. Hong Kong Import Prohibitions

The following items are generally prohibited from import into Hong Kong:

* Smokeless tobacco and snuff
* Food containing non-permitted coloring matter, artificial sweeteners, aflatoxins, preservatives, anti-oxidants, or certain metals
* Halons and CFC's (i.e. ozone-depleting substances)
* Soil
* Ivory and ivory products
* Dangerous goods as defined by IATA
* Dry ice shipments
* Personal Drugs
* Dangerous Drugs (trans shipment mode via Hong Kong)
* Controlled Chemicals (trans shipment mode via Hong Kong)










General Import Restrictions

The following items are not acceptable for carriage to any international destinations unless otherwise indicated. (Additional restrictions may apply depending on destination. Various regulatory clearances in addition to customs clearance may be required for certain commodities, thereby extending the transit time.)

* APO/FPO addresses.

* C.O.D. shipments.

* Human corpses, human organs or body parts, human and animal embryos, or cremated or disinterred human remains.

* Explosives (Class 1.4 explosives are acceptable for carriage to Canada, Germany, Japan, Sweden, United Arab Emirates and United Kingdom. Note: United Arab Emirates only allows Class 1.4 explosives to be shipped hold- for- pick-up to the FedEx Express facility in Dubai.)

* Firearms, weaponry, and their parts (acceptable between the U.S. and Puerto Rico).

* Perishable foodstuffs and foods and beverages requiring refrigeration or other environmental control.

* Live animals (including insects) except via our Live Animal Desk (1.800.405.9052).

* Plants and plant material, including cut flowers (cut flowers are acceptable from the U.S. to selected points in Canada and from Colombia, Ecuador and the Netherlands to the U.S.).

* Lottery tickets and gambling devices where prohibited by local, state, provincial or national law.

* Money (coins, cash, currency, paper money and negotiable instruments equivalent to cash such as endorsed stocks, bonds and cash letters).

* Collectible coins and stamps.

* Pornographic and/or obscene material.

* Hazardous waste, including, but not limited to, used hypodermic needles or syringes or other medical waste.

* Shipments that may cause damage to, or delay of, equipment, personnel or other shipments.

* Shipments that require us to obtain any special license or permit for transportation, importation or exportation.

* Shipments whose carriage, importation or exportation is prohibited by any law, statute or regulation.

* Shipments with a declared value for customs in excess of that permitted for a specific destination.

* Dangerous goods except as permitted under the Dangerous Goods section of these terms and conditions.

* Processed or unprocessed dead animals, including insects and pets. Taxidermy-finished hunting trophies or completely processed (dried) specimens of whole animals or parts of animals are acceptable for shipment into the U.S.

* Packages that are wet, leaking or emit an odor of any kind.

* Wildlife products that require U.S. Fish and Wildlife Service export clearance by FedEx prior to exportation from the U.S.

* Shipments* being processed under:

Duty drawback claims unless advance arrangements are made.

Temporary Import Bonds - acceptable under the FedEx International Broker Select option, for initial import only.

U.S. State Department licenses.

Carnets.

U.S. Drug Enforcement Administration export permit.

Shipments destined to or being withdrawn from a Foreign Trade Zone.

Letters of Credit (however, shipments covered by a Letter of Credit calling for a "Courier Receipt" as defined by Article 25 of UCP 600 may move via FedEx International Priority).

Certificate of Registration shipments (CF4455).

Shipments moving into or out of Foreign Trade Zones or bonded warehouses.

Hong Kong Restrictions

Hong Kong is a free port and has very few trade restrictions. Import and export licenses are required only to enable the government to enforce their international obligations, the following items are those that require a license:

* Dangerous drugs, pharmaceutical products and medicines
* Controlled chemicals: including ozone depleting substances and precursors for chemical weapons or dangerous drugs
* Endangered species (Plants and Animals) or products derived from them
* Live animals
* Plants and plant pests
* Pesticides
* Radioactive substances and irradiating apparatus
* Strategic commodities such as certain kinds of computer and telecommunication equipment, articles for a military use, etc
* Explosives, fireworks, firearms and ammunition, weapons
* Textiles
* Rice, meat, poultry
* Radio transmitting devices (includes mobile phones)
* Left-hand-drive vehicles, outboard engines (exceeding 111.9 kw/150 hp), optical disc mastering and replication equipment
* Rough Diamond (un-worked or simply sawn cleaved or bruted)






Special Import Provisions


Temporary Imports


Most goods (except liquors, tobacco, hydrocarbon oil and methyl alcohol) can be imported as temporary importations into Hong Kong if consigned for tradeshows, fairs, etc. using FedEx International Priority services. However, the shipper and importer need to be aware that some shipments may need to be moved under an ATA Carnet if they are being forwarded to another country that is not a free port such as Hong Kong. FedEx International Priority service cannot be used if an ATA Carnet is required. If the shipment is not moving under an ATA Carnet it is free to move in and out under normal import and export processing. Please contact your local FedEx customer service department if more information is needed on our services.

Personal Effects

Hong Kong grants exemptions to importers and exporters of personal effects type shipments from filing import or export declarations but does require a statement on the shipping documents that "the goods are for personal use, no commercial value". Shipments containing goods that are subject to excise tax are not exempt from excise charges even when declared as gifts or as personal effects shipments.

Samples

Hong Kong allows shipments of samples to enter with a "0" value or "No commercial value" and there is no exemption from import permits for dutiable commodities even if the shipment value is under HKD 1,000 and the shipping docuemnts state the contents are samples.

Gifts
Importers and Exporters of Gift shipments are exempt from filing import or export declarations but does require a statement on the shipping documents that the goods are for personal use, no commercial value. Shipments containing goods that are subject to excise tax are not exempt from excise charges even when declared as gifts or as personal shipments.



Standards

Hong Kong does not have an official standards authority or standardization body producing official domestic standards. Standards, if applied in Hong Kong are imposed for safety, security, health and environmental reasons and are essentially based on international standards and /or prevailing overseas standards.




General Export Clearance Information

Clearance Process


Working with Customs officials throughout the world, FedEx has developed innovative technology to eliminate many paperwork-handling steps and expedite the movement of international shipments. This is the FedEx Expressclear electronic Customs clearance system. Starting at the origin, state-of-the-art technology allows the processing of shipment paperwork and electronic transmission of documents to the designated FedEx hub and destination clearance location. The Expressclear system also keeps a database of regulatory information which includes importers' numbers, broker designation, corporate contact names and telephone numbers. At a FedEx hub, international shipments are sorted, scanned and loaded onto an international flight. Vital shipment information is keyed into a worldwide manifest database that is linked to computer systems operated by brokers and Customs officials in many countries. Even before the plane has taken off, or while it is in the air, Customs agents and brokers at the destination airport of entry can begin examining shipping manifests, querying air waybill data if they need more details, assessing duties and taxes and selecting which shipments they wish to examine. By the time the plane arrives at its destination, many packages have already been cleared by Customs. As the plane is unloaded, the Expressclear system identifies packages to be examined and prints "cleared" Customs labels for all others. Cleared shipments can be transferred to trucks for immediate delivery. International shipments are scanned at all key points throughout the process and this allows for up-to-date status reports including when Customs clearance is obtained.



Document Requirements


Air Waybill or Bill of Lading
Air Waybill is required for export of any kinds of shipments. Whenever other documents such as a commercial
invoice are included, it is important that the name and address of the foreign importer or exporter and the name
and address of the Hong Kong party are consistent on all shipping and license documents.

Commercial Invoice
It is necessary that all non-document shipments shipped via FedEx have a commercial invoice prepared and
included with the shipment when exporting to Hong Kong.

Export Declaration

It is not required for sample shipments valued below HKD1,000, gifts or personal shipments. Export License
The same commodities which require an import license are also subject to export licensing (see import license). The exporter must submit a license application prior to exportation. Export licenses may be valid for up to 3 months. The licenses include:

* Form 4 -for textile goods that are exported to all markets.
* Form 6 - for goods other than textiles but which are subject to license controls.
* Comprehensive Export License - for textile goods that are exported to non-sensitive markets.
* Export License (Strategic Commodites).
* Kimberley Process Certification (Export).


For textiles exported to sensitive markets, the Textile Trader Registration Scheme (TTRS) allows registered textile traders to submit one of the following in lieu of an Export License Form 4:

* Export Notification 1 (EN1) - for textiles of Hong Kong origin
* Export Notification 2 (EN2) - for textiles re-exports of non-Hong Kong origin

Export Clearance Process
(For Hong Kong residents and businesses exporting goods to other countries)

Export shipments usually require an export declaration except for certain exempted articles like sample shipments valued under HKD 1,000. Depending upon the commodity, an export license may be required from the government agency which regulates that commodity. For commodities subject to licensing controls, the exporter must be a licensed exporter and is responsible for obtaining the required export licenses and permits from the appropriate department(s). For textiles, Hong Kong has initiated the Textile Traders Registration Scheme (TTRS) under which certain registered companies are allowed to submit an Export Notification in place of an Export License in certain circumstances.

Export licenses are specific and are issued by the relevant government departments. Application is made by the exporter at the appropriate government department prior to tendering the shipment to the carrier (carriers, forwarders, and agents may not apply for an export license on behalf of the exporter). The licenses may be valid for up to 3 months. Goods subject to excise charges also require an export permit. The exporter is also responsible for providing Harmonized Schedule statistical data to the Census & Statistics Department within 14 calendar days of shipments departure. Prior to departure, the carrier will tender the necessary export licenses, permits or other paperwork to the Trade and Industry Department and the other government departments (some export licenses remain attached to the shipment for use by the destination government's customs clearance process).

Specific export permits are for commodities subject to export controls. The Trade and Industry Department is the government office for dual use exports (commercial items that may have military applications).
